Baja Amigos, LLC. is registered, owned and operated from Florida, USA. Baja Amigos, LLC offers escorted trips from the United States border beginning at Tecate, Baja California, Mexico to Los Barriles, Baja California Sur and return to El Centro, California. The following terms and conditions will apply for all tours:
All fees and deposits are calculated in US Funds. These must be paid in US funds. We do NOT accept Canadian currency. Upon registration, a nonrefundable $495 USD Deposit per RV is required to reserve your spot within our Caravan.
The balance of fees will be payable in 2 installments, with the final payment due 90 days before the scheduled rendezvous date. Upon receiving the deposit, a confirmation and receipt will be mailed to you. Upon receiving the balance & final payment, a Pre-Trip Information Package with a checklist will also be sent to you.
CANCELLATION POLICY
Here is a summary of our Cancellation Policy. Please read below for more details:
- 90+ days before start date: Refund 100% of fees paid minus deposit
- 60–90 days before start date: Refund 66% of fees paid minus deposit
- 30–60 days before start date: Refund: 33% of fees paid minus deposit
- Less than 30 days before start date: No refund (100% of tour fees forfeited)
Cancellation by the guest for any reason, received in writing 90 days or more before the scheduled rendezvous date, will result in a refund of monies paid to date, minus the $495 USD non-refundable deposit. No questions asked. The non-refundable deposit may be transferred to the next tour season, but not beyond 1 year.
Cancellation by the guest in writing less than 90 days but more than 60 days before the scheduled rendezvous date for a bona fide medical reason must be accompanied by a physician’s statement verifying inability to travel OR for a bona fide mechanical reason must be supported by a repair bill or estimate showing that the vehicle will be inoperable during the Caravan dates OR because of a death in the immediate family should include a physician or hospital statement or newspaper obituary will be refunded 66% of the final payment.
Cancellation by the guest in writing less than 60 days but more than 30 days before the scheduled rendezvous date for a bona fide medical reason must be accompanied by a physician’s statement verifying inability to travel OR for a bona fide mechanical reason must be supported by a repair bill or estimate showing that the vehicle will be inoperable during the Caravan dates OR because of a death in the immediate family should include a physician or hospital statement or newspaper obituary will be refunded 33% of the final payment.
Cancellation by the guest less than 30 days before the scheduled rendezvous date for any reason will result in a forfeiture of all paid tour fees.
NO REFUND OR CREDIT will be given after the caravan begins unless due to sudden serious illness, death or serious unforeseen mechanical problems. You will receive a pro-rated refund, less the $495 USD non-refundable Deposit to a maximum of seven (7) days.
If, for any reason, you decide to leave the caravan to travel and stay on your own and do not rejoin the caravan, NO FEES ARE REFUNDABLE.
TRIP INTERRUPTION INSURANCE. If you are concerned about potential health issues or other life circumstances that might limit your ability to attend the caravan, we strongly advise you to consider trip interruption insurance. Every year, at least one guest must cancel within 30 days of tour commencement, and, unfortunately, fees are not refundable at that point. Trip Interruption Insurance may help you recoup your fees.
We recommend Trawick for trip insurance, which is made available at checkout.
BAJA AMIGOS, LLC. RESPONSIBILITY:
Baja Amigos LLC’s responsibility is to organize and guide the caravan tour. It is agreed that all persons joining said caravan are doing so entirely upon their own initiative, risk and responsibility, and have complete and unrestricted control over their actions and own vehicle(s). In respect of Baja Amigos, LLC’s function to organize and guide the caravan, whoever is joining said caravan agrees to assume all risks of accident or damages to themselves or their property, and hereby releases and agrees to indemnify Baja Amigos, LLC and it’s agents from all liability, loss or damage claim, or punitive course of action, whether or not caused by Baja Amigos, LLC action or it’s agents.
In respect of Baja Amigos, LLC. providing guests’ optional transportation to any locations, whoever is joining these activities hereby releases and agrees to indemnify Baja Amigos, LLC and it’s agents from all liability, loss or damage claim, or punitive course of action, whether or not caused by Baja Amigos, LLC. action or its agents.
We reserve the right to cancel or alter any itinerary as conditions require. Changes may involve sightseeing events, excursions, campgrounds, and /or meals. We reserve the right to substitute excursions, events, and campgrounds when scheduled ones are not available. Baja Amigos, LLC. reserves the right to cancel any scheduled RV caravan tour before departure. In that event, all deposits and payments will be fully refunded, minus service fees.
Baja Amigos, LLC operators are not responsible for any additional expenses incurred due to delays caused by weather, acts of God, mechanical problems or other circumstances beyond our control, including but not limited to severe weather events or acts of violence by the Mexican government and/or bad actors such as cartels. As long as travel in Baja remains safe for our Guests, we will not cancel any caravan. However, we may choose to modify the itinerary and/or delay the departure as circumstances merit.
A Note on Travel to Mexico: By agreeing to these Terms and Conditions, Guest understands that they are traveling in Mexico, a sovereign country operating under its own laws and culture. There are inherent risks when traveling to Mexico, subject to terms beyond our control. We will adhere to all travel advisories and/or restrictions by the US and Canadian governments. However, tours will continue as scheduled unless either/or the US and/or Canadian governments place a “Do Not Travel” advisory for Mexico. We will operate with the safety of all guests in mind, but will also follow the counsel and guidance of our own Mexican contacts throughout the Baja Peninsula.
Participants (“Guests”) in the Caravan agree to join the Caravan, abide by the general principles outlined below and pay for the Caravan expenses outlined in this Agreement.
- Wagonmasters are not responsible for the individual actions of guests, including any legal consequences for such actions, but will act merely in an advisory role. Read further for more information on Guest expectations while on any Baja Amigos, LLC caravan.
- Wagonmasters are not liable for vehicle breakdowns or any damages to property or persons resulting from Guest accidents or vehicle malfunctions. They will consult with, intervene for and assist the Guest to the best of their ability but assume no responsibility for the outcome of any situation.
- Wagonmasters will make all reasonable efforts to inform and provide for Guest safety throughout the Caravan. However, by committing to joining the Caravan, you agree to release Wagonmasters formally and Baja Amigos, LLC from all liability, loss or damage claims or punitive course of action, whether or not caused by Wagonmaster’s action.
Tours and excursions are to commence at the time scheduled and, in the manner scheduled. We reserve the right to cancel or alter any tour or excursion as conditions require. Any changes are made in the guests’ best interest or due to circumstances beyond our control, caused by weather, acts of God, mechanical problems, or other circumstances beyond our control. While extremely unlikely, Baja Amigos and its representatives will do their best to help resolve unexpected mechanical issues with the Client’s RV/vehicle. Still, they will make decisions that are in the best interest of the entire caravan, which may result in leaving the Guest with reasonable help while continuing to lead the caravan through the itinerary.
Notwithstanding optional excursions, Baja Amigos acts only as an agent for other transportation companies, sightseeing, fishing, whale watching, kayaking, diving tours, etc., and is not a principal or operator for the subject services. Guests joining these activities hereby release and agree to indemnify and its agents from all liability, loss or damage claims, or punitive course of action and, as such, accept no liability.
If, for any reason, you decide to leave the caravan to travel and stay on your own and do not re-join the caravan again, NO FEES ARE REFUNDABLE.
Wagonmasters have the following responsibilities to all Guests:
- Plan, organize and operate the Caravan as guides, to pay for all camping, select meals, activities and tours included in the Caravan.
- Guide the completion of the required documents for border crossing
- Provide generally safe and secure camping and other parking opportunities
- Provide daily briefings, particularly before drive days, to review the plan of the day and any related details required throughout the day
- Assist the Guest with the formal immigration procedures whenever possible
- Assist the Guest, if possible, in the event of police or other law enforcement involvement with the Guest
- Assist in any emergency or urgent situation, medical or otherwise, as is possible, feasible and safe to do so
- Cancel and/or reschedule activities due to inclement weather or other conditions that could present unreasonable harm to Guests
Of specific note, the following conditions apply to limit the Wagonmaster’s responsibility over the Caravan:
- Wagonmaster are not responsible for the general health and welfare of Guests beyond the above agreements, which are intended to provide Guests with the best possible travel experience while not taking responsibility for individual Guest actions.
- Guests are all legal adults and remain ultimately responsible for their actions 100% of the time during the Caravan. Wagonmaster may provide counsel, warnings, or otherwise notify Guests of appropriate behavior, but does not assume responsibility for any Guest actions.
- Wagonmasters may act only in advisory roles to assist guests with any positive or negative experiences during the Caravan, including limited translation, firsthand experience, and the coordination of local assistance when needed.
Baja Amigos, LLC and Wagonmasters are also not responsible for any additional expenses incurred by Guests due to weather, acts of God, mechanical issues or other circumstances beyond our control.
CLIENT (“GUEST”) RESPONSIBILITY:
Clients (“Guests”) are responsible for their health insurance, vehicle insurance, travel cancellation insurance, US Camping fees unless specifically included in the tour, personal behavior, conduct, driving infractions and fines, mechanical maintenance and repair, and certification of their vehicle(s). Clients are also responsible for obtaining all required travel documents and vehicle permits for the region in Mexico they are traveling in.
Wagonmasters reserve the right to eject from the tour, without refund, any caravan guest if his or her conduct is, in the opinion of the Wagonmaster or, contrary to the best interest of the caravan harmony or if their actions, conduct or behavior legally, morally or potentially jeopardize the well-being, harmony, safety or security of the group.
Guests, acting individually as part of the Caravan, agree to the following responsibilities:
- Arrange for a thorough mechanical inspection of their RV, trailer and/or vehicle(s) before the commencement of the Caravan and complete all recommended repairs or preventative maintenance accordingly. Be prepared to provide a copy of the completed inspection and repairs to Wagonmaster.
- Follow all reasonable guidance, requests, and actions provided by the Wagonmaster as they pertain to all aspects of the Caravan during its duration.
- Obtain the following, as required or desired:
- Mexican Auto & RV Insurance (REQUIRED)
- Health Insurance and/or (ADVISABLE)
- Travel Insurance and (ADVISABLE)
- Trip Cancellation Insurance (ADVISABLE)
- Pay for the following expenses for the duration of the Caravan:
- Mexican Auto/RV Insurance
- FMM Immigration Documentation
- Personal meals and groceries
- Tours and Activities
- Fuel
- Tolls, parking and other required transportation fees
- Mechanical repairs as necessary
- Driving infractions and fines
- Monitor personal behavior and conduct during the Caravan, including in public or private settings. We acknowledge that each Guest is entitled to his/her own opinions. However, public expressions of racism, sexism, bigotry, homophobia and general hate will not be tolerated while on the Caravan. If a Guest engages in this behavior, they will be given one (1) warning. If the action continues, they and whoever they may be traveling with in their RV will be ejected from the Caravan immediately and no refund will be provided.
- Agree to use handheld radios to communicate appropriately with Wagonmaster and other Guests during the Caravan. Radios are to be used for formal purposes only, not for chatter with other Guests.
- Follow the requests of the Wagonmaster at all times, including during drive days and in decisions regarding camping spots, community meal locations and so forth. All requests will be deemed reasonable 100% of the time on the Caravan and should be followed immediately, particularly regarding the safety and welfare of this or any Guest. Any disagreement should be handled privately so your concerns can be aired and reconciled appropriately between you and the Wagonmaster.
- Do not fail to attend, deviate from, or leave the Caravan for any reason without previously consulting the Wagonmaster. All tours and Caravan group meals can be skipped with prior communication with the Wagonmaster.
A Note on Guest RV Experience: As part of the Registration process, we ask Guests to indicate how long they have been RVing and how long they have owned their current RV. Guests must have a very clear understanding of how their RV operates and any limitations it has before agreeing to these Terms & Conditions. We require each Guest to complete a strict Mechanical Checklist. However, Guests must also understand individual systems and processes within their RVs, including but not limited to power operation, battery capacity (types and amount), solar and/or generator use, waste tank space and limitations and so forth. More issues arise from Guests not understanding the limitations of their own RVs than from external forces acting upon them. Guests should be able to “dry camp” for 3-4 days without water, power or sewer connections.
Any guest who does not show up, deviates from or leaves the caravan early for any reason other than the permitted exclusions is NOT entitled to a refund of fees paid.
Clients grant full permission to any and all use of his/her likeness, including photographs shared and video taken on tour for publicity, marketing and advertising purposes without compensation.
By registering with the Baja Amigos, making a deposit and final payment, guests understand and agree to abide by the terms and conditions of this agreement. Please be advised that, without exception, each adult person in your party will be required to sign a printed copy of this agreement (Page 8, below) before the RV Caravan commences.
